| 摘 要： | 取保候审的适用在司法实践中出现了许多问题,有学者提出用保释制度替代取保候审制度,由于制度是与诸如司法观念、诉讼模式等紧密相连的,因此,引进保释制度将会因制度和观念性的障碍而无法有效发挥作用。
