| 摘 要： | 本文以法律文化概念在国内外法学界的不同构建模式作为特定学术个案，通过相关学术史考察，呈现背后的法学方法意蕴。文章首先简要介绍了从文化概念到法律文化概念的变迁历程，然后指出国内学者对于法律文化概念构建的视角、意义、局限，最后指出对法律文化概念进行精确的概念构建并不现实，将法律文化概念作为法学研究的核心范畴也缺乏足够的操作性。

| Abstract: | This paper analyzes the origin of the concept of Legal Cultural, pionts＇ out different attempts about the concept and their own value. In his opinion, we could not have a certain defining of ＂legal culture＂,and the concept also could not been treated as a core category in the study of the Science of Law. |
