| 摘 要： | "执行难"成为司法实践中一个突出问题,已严重影响了司法的权威和公信力。为解决"执行难",经历了审执一体到审执分立的司法改革,但审执分立也导致了审理只管判案不考虑执行,直接或间接加剧了执行的难度。只有二者在配置上体现相对独立性,统筹兼顾、协调一致,才能有效解决审执断裂问题。
