| 摘 要： | 城市房屋行政强制拆迁是当代社会关注的热点问题。由于行政强制拆迁程序法律规范的缺失,实践中严重侵害拆迁相对人合法权益的现象时有发生。拆迁问题中最突出的问题即拆迁补偿问题。对国内外的土地补偿制度和拆迁补偿制度进行述评和比较,分析国内外土地补偿的各种学说,并且进行简要评述,以此为基础对我国的拆迁现状提供一些建议。
