On Jurisprudence Basis for Urban Land Banking System

Urban land banking system is an important achievement of state-owned land use reform. It has contributed to implementation the urban planning, propelling thrift and intensive utilization of city land and protecting stateowned land proceeds. The system can be justified by public interest theory. The theory of ＂managing city＂ embodies demand of ＂public appreciation of land ＂, the ultimate goal is to safeguard public interests. We can take foreign land banking experiences for reference not only in system design but also in the details. The land reserve system has achieved some success ,but there are still many issues to be resolved.
