论城市土地储备制度的法理基础

摘    要:城市土地储备制度是国有土地使用权改革的重要成果。它有助于落实城市规划,推动城市土地的集约节约利用,保障国有土地收益。该制度的正当性基础在于公共利益理论。经营城市说体现了“土地涨价归公”的要求,最终目标仍在于公共利益的维护。在制度设计和操作细节方面,国外土地储备的经验仍可给我们许多借鉴。土地储备制度虽然取得了一定成效,但仍然存在不少问题有待解决。

Abstract:Urban land banking system is an important achievement of state-owned land use reform. It has contributed to implementation the urban planning, propelling thrift and intensive utilization of city land and protecting stateowned land proceeds. The system can be justified by public interest theory. The theory of "managing city" embodies demand of "public appreciation of land ", the ultimate goal is to safeguard public interests. We can take foreign land banking experiences for reference not only in system design but also in the details. The land reserve system has achieved some success ,but there are still many issues to be resolved.
