基于义务视角探析住房权实现之问题与矛盾

住房权属于社会权下的具体权利,其实现需要国际社会、国家和个人承担不同的责任和义务,然而三个层面的不同义务都存在着不同程度的问题与矛盾：国际层面,住房权实体性义务与程序性义务严重不平衡;国家层面,呈现美好理想状态的一般义务与无奈现实之间进行着博弈;个人层面,自我保障与政府阻碍之间不断地拉锯。这些问题与矛盾的存在,昭示着住房权的根本解决更多的是一种进程,而不仅仅是一种建立起来的法律文本结构,其实现在理论上和实践中都还有漫长的路要努力。

Angles of the Obligation Based on the Realization of Housing Rights Problems and Contradictions

The right to housing belongs to economic, social and cultural rights and its realization needs the international community, national and personal commitment to bear different responsibilities and obligations. However, there are different degrees of problems and contradictions in the different obligations of the three levels. On the interna- tional level,housing rights obligations of substantive and procedural obligations are in a serious imbalance. On the national level, the seemingly ideal status of the general obligation fights against helplessness of reality. In the individual level, self-protection and the Government continue to see-saw between the obstacles. The existence of these problems and contradictions,indicates that the fundamental solution the right to housing is more of a process, rather than setting up the structure of legal texts. In fact, both theory and practice still have a long way to go.
