| 摘 要： | 我国立法目前只规定鉴定结论而不采纳专家证言证据,既不符合诉讼的科学规律,也不利于对涉及专门性问题的诉讼审查与准确判断,也无法从根本上解决目前在司法实践中存在的各种问题。因此,应当借鉴英美法系的专家证人制度以及有关国家的先进立法,在行政诉讼中建立专家证人制度,增加专家证人证言作为鉴定结论的补充,丰富专家证据的形式。

| Abstract: | The legislation in China only prescribes appraisal conclusion and does not adopt expert witness evidence,which does not fit for the scientific rules of lawsuit and is harmful to the examination and accurate judgment of lawsuit.As a result the legislation in China can not solve all kinds of problems in the current judicial practice.Therefore,China shall refer to the expert witness system in Anglo-American Law System and the advanced legislation in the relevant countries.China shall establish an expert witnes... |
