| 摘 要： | 应如何规定人格权 ,是我国制定民法典中的问题之一。人格权关系属于基本的民事法律关系 ,应当“入典”;然而 ,人格权关系在权利的得失变更方面 ,与其他民事法律关系又有区别 ,因此不宜“独立成编”。

| Abstract: | How to arrange the system of the personal rights in the civil code is one of the important problems in the drafting of the China's Civil Code.Based on the theory of legal relations and the techniques on how to arrange the legal relations in the code,this article holds that the personal relations are the basic civil relations,and therefore they must be contained in the Code.However,the personal relations are different from the other civil relations in the generation,change and termination of the rights,so the China's Civil Code should not contain an independent part on the personal rights.In the last part,this article also put forward some suggestions about how to arrange the system of the personal rights in the Civil Code. |
