| 摘 要： | 根据价值取向的不同，非诉解决模式可以分为：效率主导、公平主导、二者兼顾；根据主导者的不同，非诉解决模式可以分为：司法主导、行政主导、民间力量主导；根据程序和效力的不同，非诉解决模式可以分为调解和仲裁。我国的医疗纠纷多，诉讼解决效率无法令人满意，民间力量主导的调解组织在中立性、高效性方面拥有一定优势，代表着医疗纠纷非诉解决机制的未来。

| Abstract: | According to the value orientation, the non-lawsuit settling mechanism is divided to efficiency oriented, equity oriented and the mixed one. According to the dominant role, it can be divided to judiciary oriented, administration oriented and the folk power oriented one. According to the procedure and executive force, it can be divided to mediation and arbitration. There are lots of medical disputes in China, while the solving efficiency is not satisfying. The mediation organizations oriented by the folk forces, with the advantage on neutrality and high-efficiency, represent the future of non-lawsuit settling mechanism of resolving the medical dispute. |
