加强法治,促进和谐——论法治在构建社会主义和谐社会中的地位和作用

和谐是一个古老而又经久不衰的跨学科概念,具有美学本源、哲学基础、社会科学基础和实践意义。社会主义和谐社会是民主法治、公平正义、诚信友爱、充满活力、安定有序、人与自然和谐相处的社会。民主法治在和谐社会的全部内涵和基本特征中具有统揽全局、支撑全局的作用。法治是构建和谐社会最重要的机制。建设社会主义和谐社会,要围绕人与人的和谐、人与社会的和谐、人与自然的和谐、中国与世界的和谐这四个方面发挥法律的引导和维护作用。和谐社会的法制保障包括立法保障、执法保障、司法保障和守法保障四个方面。

To Strengthen the Rule of Law and to Promote the Harmony: On the Role of the Rule of Law Plays in Constructing the Socialistic Harmonious Society

Harmony is an old and unfailing interdisciplinary concept with aesthetic fountain,philosophical base,social science groundwork and practical significance.The socialistic harmonious society is the society of democracy,rule of law,justice,fairness,credit,humanity,vigorousness,stableness,orderliness and which gets on well with the nature.Democracy and rule of law make the essence and core of the whole connotation and basic attributes of the harmonious society.Rule of law is the most important mechanism to construct the harmonious soci- ety.In building the socialist harmonious society,the harmony among individuals,the harmony between individual and society,the harmony between man and nature,the harmony between China and the world are the four main di- meusions that law should try to guide and protect.The approaches of the legal protection of the harmonious society includes legislation,law-executing,judicature and law-abiding.
