认罪认罚案件上诉问题研究

我国2018年修改后的《刑事诉讼法》未对认罪认罚案件的上诉问题作出具体规定。鉴于认罪认罚案件可能包含被告人对权利的放弃等原因,应对其是否设置上诉权、上诉权的范围、上诉审查及二审如何处理进行法律完善。参考域外认罪协商类制度上诉权的范围以及被告人权利保障、司法风险、效率等价值之间的平衡,我国应限缩认罪认罚案件的上诉权。应基于被告人上诉的真实动因进行分类,设置有条件的上诉权。认罪认罚案件上诉的审查方式为基于被告人认罪自愿性的审查,宜引入无效辩护概念;二审处理中应增加违背意愿认罪情形等的规定。

Research on Criminal Appeal of Cases Applied Lenient Punishments on Those Confessing to Their Crimes and Accepting Punishments

Criminal Procedure Law of 2018 does not make specific provisions for the appeal ofcriminal cases applied Lenient Punishments on Those Confessing to Their Crimes and Accepting Punishments.As there may contains the defendant’s waiver ofrights and other reasons,there needs legal perfection of the legitimacy of appeal right,the range of appeal right,appellate review,andsecond instance’s trial of criminal cases appliedLenient Punishments on Those Confessing to Their Crimes and Accepting Punishments.With reference tothe value balance of defendant’s right,legal risks and efficiency in extraterritorialleniency systems,China should limit the range of right to appeal in cases applied Lenient Punishments on Those Confessing to Their Crimes and Accepting Punishments.The defendant’s real reason to appeal shall be classified first,then set conditional appeal right.The appellate review of cases applied Lenient Punishments on Those Confessing to Their Crimes and Accepting Punishments shall based on defendant’s voluntary to confession,then introduce of the concept of ineffective assistance of counsel;perfect second instance’s trial regulations by adding conditions of confession against the will.
