| 摘 要： | 不真正连带之债是现实生活中广泛存在的一种债的类型,它具有不同于连带之债的独立价值,是一种优秀的民事法律制度。但由于我国立法对此没有明确的规定,在实践中也颇多分歧。本文试图对不真正连带之债的概念、性质、类型及其效力等作一探讨,以期在理论上引起关注。

| Abstract: | The unreal joint and several obligation is one kind of debts in the real life which widely exist. It has an independent value compared to joint and several obligation, and is one kind of outstanding civil legal system. However, because our country's legislation has no explicit stipulation regarding this, there remains a lot difference in practice. This article attempts to probe into its concept, nature, type, potency and so on, in the hope that it can theoretically arouse more attention. |
