| 摘 要： | 民事主体与民事主体结构是两个不同的概念 ,二者随着社会经济的发展变化而发展变化。本文对理论界研究民事主体结构的观点进行反思后 ,论证非法人组织、国家应当成为独立的民事主体类型 ,自然人、法人、非法人组织、国家并列的民事主体四元结构 ,是我国民事立法的最佳选择。

| Abstract: | Civil subject and the structure of civil subject are the different concepts. They change with the development of the social economy. The thesis reviews the theories of structure of civil subject in the academia and points out that unincorporated organization and state should be the independent types of civil subject and it will be the best choice in China's civil legislation that the civil subject includes natural person, juridical person, unincorporated organization and state. |
