从《物权法》的规定看登记对抗主义的合理性

关于不动产物权登记的立法模式,国外有三种立法体例,即：登记对抗主义、登记要件主义及托伦斯主义。我国2007年出台的《中华人民共和国物权法》对于不动产物权的登记模式有了一定的规定。通过全面归纳《物权法》中关于不动产物权登记模式的规定,可以看出,《物权法》中存在不动产物权登记对抗主义的模式,这说明不动产物权登记对抗主义有一定的合理性。通过探讨不动产物权登记对抗主义的优越之处,可以发现不动产物权登记对抗主义有存在的合理性。

The Rationality of Registration Antagonism in Property Law

There are three legislative styles about the real property registration mode abroad. Those are： Registration Antagonism, Registration Effectiveness and Torrence. Enacted in 2007, the Property Law provided the model for the real property registration. Through comprehensively summarizing all the provisions of the real property registration mode in the Property law, we can find that the Registration Antagonism mode for the real property registration was provided by the Property law. That was to say the Registration Antagonism mode for the real property registration has its own rationality. Through mainly discussing the advantages of the Registration Antagonism mode for the real property registration, we can find the rationality of existence of the Registration Antagonism mode for the real property registration.
