投毒杀人案件侦查取证研究

当前在投毒杀人案件侦查取证中,存在的主要问题是:取证不及时、不全面和缺乏针对性,物证保全不当和送检不及时。针对这些问题,侦查人员在侦查时,应以投毒现场为中心,围绕投毒方法、毒物来源、因果关系、危害后果等全面取证。现场勘查时,除提取常规痕迹外,还要着重提取投毒杀人案件的特有痕迹物证;审讯犯罪嫌疑人时,要设法固定口供;要完善证据体系,学会运用间接证据证明投毒杀人的犯罪事实。

A Study about the Invertigation and Evidence of the Homicide Cases by Poisoning

In investigating the homicide cases by poisoning and collecting the evidences,there exist some main problems like:unseasonal uncomprehensive and impertinent obtainment of the evidence,unsuitable preservation of the material evidence and untimely submission for censorship.In view of the problems,when investigating,investigators should obtain comprehensive evidences about the way of poisoning,poison sourse,causality and damage aftereffect centering on the poisoning spot.When investigating the site scence,investigators should collect the common signs and especially the material evidence with peculiar signs.When interrogating the suspect,the staff should try to fix up the oral confession and they should perfect the evidence system and learn to use the indirect evidence to prove the corputs delicti of homocide by poisoning.
