| 摘 要： | 鉴于未成年人犯罪的特殊性,世界各国均规定了未成人犯罪记录封存或消灭制度,旨在为未成年犯罪人顺利回归社会创造条件。以新《刑事诉讼法》“未成年人刑事案件诉讼程序”和“两高三部”《关于建立犯罪人员犯罪记录制度的意见》为标志,中国特色的犯罪记录制度初步建立起来。与国际刑事司法标准和法治发达国家立法相比,我国未成年人犯罪记录制度仍存在较大差距。应当以宽容理念为指针,构建符合中国实际的未成年人犯罪记录制度。

| Abstract: | In view of special nature of minor crimes, all countries in the world prescribed minor criminal record sequestration and destruction system in order to create conditions for minor offenders return to society smooth- ly. As a symbol of new ＂Criminal Procedural Law＂ and ＂Opinion of establishment of minor record＂ （ the Su- preme Court and Procuratorate and two Departments）, criminal record system with Chinese characteristics has been established initially. However, compared with the international standards of criminal justice and legislation in the legally developed countries, Chinese minor criminal record system still has a big gap. We should take tol- erance idea as a pointer to build a minor criminal record system according with Chinese actual. |
