网络虚拟财产继承问题研究简

网络虚拟财产是一项新型财产权,这决定了其继承问题应纳入继承法规范,但其存在着与传统财产权继承不同的特殊问题。网络虚拟财产是基于网络服务商的网络服务而产生的,但用户购买或创造的网络虚拟财产具有独立的价值,属于用户所有,网络服务协议不能排除其合法继承。保护死者隐私最终是为了保护死者近亲属的权益,因此用户死亡后由近亲属继承其网络虚拟财产不会存在侵害死者隐私的问题。

A Research on the Problems of Network Virtual Property Inheritance

The network virtual property is a new property right, which determines that their succession should be incorporated into the inheritance law, but there are some special problems different from inheritance of tradi- tional property rights. Network virtual property＇ s production is based on internet service provided by network services provider, but the network virtual property which user purchases or create has independent value, be- longs to all of the user. Network service agreemeet cannot exclude its legitimate inheritance. Protection of the privacy of the dead is to protect the rights and interests of the close relatives of the dead, so the close relatives inherit network virtual property after the death of the user doesn＇ t infringe upon the privacy of the dead.
