Basing on the double-layer multi order theoretical system of crime constitu- tion, the characteristics of facts of the content of punishment condition should be placed in the double-layer multi order system of crime constitution. And the relevant function which punishment condition wants can be a- chieved through the double-layer multi order system of crime constitution. This follows the basic idea of ＂the constitution is the basic clue and the subjective responsibility is necessary＂ in the theory of crime constitution.
