| 摘 要： | 整个刑事政策的历史以及现代各国刑事政策的主流,都是以报应性正义为指导的,而现代各国犯罪率特别是再犯率居高不下,使人不能不对报应性正义指导下的刑事政策产生怀疑,在此背景下,人们开始将目光投向一种新的正义目标:恢复性正义,并以各种方式去实践。

| Abstract: | The main trend of criminal policy has always been directed by the retributive justice so far in almost all the countries. As the crime rate and the rate of repeating crimes become higher and higher, people begin to doubt the effect of the criminal policy guided by retributive justice. Under such circumstances, they try to look for a new concept of justice, restorative justice, and put it into practice in all kinds of methods. |
