| 摘 要： | 法律是一种稀缺的社会资源 ,要做到对法律的有效运作 ,就必须通过市场机制对这种资源合理配置。作为制度规范的法律供给拥有供给者与需求者效用函数的基本一致性、具体法律供给者获得效用的“自利性”、“法律供给的不确定性、法律供给的天然垄断性 ,主体的非市场性、法律供给的强制性等五大特点。通过经济学对其进行分析 ,得出有效结论以供各方参考

| Abstract: | The effectiveness of law depends on the collocation of market system to law which is a kind of rare social resource. As the systematic regulation, the legal supply appears with five characteristics of basic unification of effectiveness of both the supplier and the demander, self benefited effectiveness of certain legal supplier, uncertainty, natural monopoly, non marketing, compulsion. The beneficial conclusion from the analyses of theory of economics can be used for reference. |
