1920—1940年代南京国民政府的工会立法研究

南京国民政府的工会立法是1920—1940年代工人生存状况恶化、劳资矛盾尖锐化、工人运动勃兴及国际国内社会舆论形成的压力与推力的结果。它借鉴了北京政府和广东政府工会立法的经验，对中国的近代化产生了积极影响。它部分地实现了工人阶级的利益，在一定程度上缓和了阶级矛盾。但是南京国民政府的工会立法大多数是从西方国家的工会立法中借鉴过来的，有的脱离了中国的实际。而且它的目的显然是以保障为诱饵，对工人进行控制，如《工会法》、《劳资争议处理法》等法规，都包含控制工人、限制工人罢工的内容。尽管如此，它在立法上的得失，仍可为当代中国的工会立法提供历史借鉴。
