特殊侵权责任的意识——析高度危险作业的范围

本文通过两则个案的系统分析 ,展示了特殊侵权行为在审判实践中的运用情况。针对这种情况 ,作者认为法官及当事人自己对于特殊侵权行为的认识是远远不够的 ,对于由此而产生的民事责任与一般民事责任的不同也不够重视 ,尤其是在归责原则和民事责任的范围上更是如此。这必然影响到案件的公正审判 ,而且这种情况普遍存在。作者建议应当在立法中明确高度危险作业的范围 ,并使之具有可操作性 ,以实现法律的基本目的 ,保护受害人利益 ,公平分配责任。

The Sense of Special Tort Liability--The Extent of the High-Risk Operation

The thesis, based on the analysis of the two substantial cases, reveals the state of application of special tort action in the judicial practice. As such, the author believes that it is not enough for the person concerned to recognize his or her tort. Furthermore, such cases caused are quite different from general civil liability: especially in view of extent of the doctrine of liability fixation civil liability.
