| 摘 要： | "政府利益分析说"曾经给冲突法带来变革性的影响,但由于其固有的缺陷,慢慢走向没落.在网络时代,有学者在汲取"政府利益分析说"精华的基础上提出"新政府利益分析说"--"共同利益说".从法律理念上认识共同利益分析说,应该说,它是具有生命力的,尽管可能目前是孢子状态,将来却一定会萌生.不过,从国际社会的法律特性看,当今国际社会仍是由国家本位观念占主导地位.

| Abstract: | The theory of government interests analysis had affected conflict of laws innovatively, but it declined gradually for its inherent defects. At the time of Internet, some scholars put forward new theory of government interests analysis--the theory of common interests based on the essences of the theory of government interests analysis. The article compared the two theories, confirmed the theory of common interests and discussed its limitations. |
