公共利益诠释

“公共利益”作为不确定法律概念,其内涵至今难以明确界定,然而还是能够找到人们对这一概念认识的共识。对于公共利益的形成及其与个人利益之间的关系,必须把各种不同的利益予以特定化之后才能确定,不能仅从抽象的角度考虑。也就是说,必须把利益归于特定的主体名下,才能具体地确定他们之间的关系。公共利益与个人利益之间既有一致性,又有冲突性。要妥善解决二者之间的冲突,有一些最基本的原则需要遵循。

Explanation of Public Benefit

It is hard to give definitions public benefit,but educational circles still get to a common view.We should specialize every different benefits when we want to understand the relationship between public benefit and indi- vidual benefit.There are both coherence and conflict between them,and some principles should be followed when we want to settle their conflict.
