印章犯罪研究

由于具有证明个人和单位的同一性的重要功能,印章在现代社会生活中起到极其关键的作用.伪造、变造、买卖、盗窃、抢夺印章等行为,导致印章的真实性受到损害,从而损害了公众对于印章的真实性的信赖.我国刑法中规定了伪造、变造印章类犯罪和买卖、盗窃、抢夺、毁灭印章类犯罪.详细研究这两个类犯罪的构成要件和认定中存在的问题,能够为刑事司法实践中的准确定罪和适当量刑提供指导.结合司法实践分析,我国刑法关于印章犯罪的规定存在一些问题,解决这些问题,对于完善我国刑法具有非常重要的作用.

On Seal Crime

With important function of testifying identity of individuals and entities,seals play an important role in modern social life.Forgery,alteration,transaction,theft and seizing by force of seals impair their authenticity,so they infringe the trust of the public in their authenticity.The Criminal Law of China forbids two types of offenses on seals,including offenses against forgery and alteration of seals and those against transaction,theft and seizing by force of seals.To study the constitutive elements of such offenses and relevant frequent issues in judicial activities can guide correct conviction and proper sentence.
