命案的边际社会成本明显高于其他案件,其数量应控制在比其他案件更低的水平。降低命案发案率有两条途径:一是加大惩罚力度,二是加大作案者被逮捕与定罪的概率。但命案自身的特性决定了后者的效果优于前者。犯罪经济学分析表明,在一定的约束边界内“,命案必破”是必然和正确的选择。

As the marginal social cost of homicide cases is significantly higher than that of other cases,their numbers should be kept at lower level.There are two ways to reduce the number of homicide cases.One is to apply a more severe punishment,while the other is to increase the offender's possibilities of apprehension and conviction.However,the nature of homicide cases leads to the fact that the latter way has a better effect than the former.Crime economic analysis indicates that within the range of certain restrictions,"homicide cases must be cracked" is an inevitable and correct choice.
