适当成年人介入制度在我国应该缓行

未成年人在国际社会是受专门制度保护的特殊群体,如刑事司法领域的适当成年人介入制度等。适当成年人的介入有利于引导未成年犯罪嫌疑人和有精神障碍的犯罪嫌疑人更好地接受讯问;遏制刑讯逼供等非法行为;推进程序顺利进行。该制度的建立需要充足的适当成年人储备、充裕的经费支持并需要与沉默权制度、非法证据排除规则等配套运行。这些条件在现阶段的我国尚不具备,因此,我国目前并不适宜建立适当成年人制度。

In the international community,the minor is the special group protected by special system,such as the system of ＂appropriate adult＂ intervening in the criminal cases.The ＂appropriate adult＂ plays an important role in guiding the minor suspects and the spirit suspects to answer the questions better,containing the act of extorting confessions by torture and other illegal acts,and promoting the application successfully.The establish and function of the system not only require abundant appropriate adults and plenty of money,but also need particular systems to support,such as the system of right to silence,the exclusionary rule of illegally obtained evidence,and so on.However,on account of these conditions deficiency,it＇s not the proper time for China to introduce into the system.
