摘    要:自市场经济以来,我国劳动关系从纯国有经济的劳动关系发展到私营经济劳动关系、三资企业劳动关系和跨国公司劳动关系,直至私人小作坊和非法用工主体的雇佣关系。可以说,我国近代经济史上存在过的所有类型的劳动关系和雇佣关系,在现阶段都得到了淋漓尽致的展示。而如何准确地把握住具有共性但又有着区别的劳动关系和雇佣关系,则有着十分重要的现实意义。该文在众多学者研究的基础上,主要对劳动关系与雇佣关系的定义、特征、要素及其两者之间的联系和区别进行阐述,并对如何调整雇佣关系提出建议,以达到抛砖引玉之目的。

Abstract:Since the market economy have been building,our country's labor relation has developed from the pure state economy labor relation to the private sector labor relation,the Three Funds Enterprises labor relation and the multinational corporation relation,until the employment relation of the personal small workshop and illegal employee.It can be said,all types of labor relation and employment relation that existed in our country modern times all obtained the incisive demonstration in the present stage.But how accurately grasp labor relation and employment relation which have the general character but also have the differences,then has the extremely important practical significance.This article based on the studies of multitudinous scholar,mainly elaborate the labor relation and employment relation's definition,character,essential factor and the relation and differences between its two relations,and put forward the proposal to how to adjust the employment relation,by achieved the goal of offering a few ordinary introductory remarks so that others may offer their valuable ideas.
