| 摘 要： | 在宪政民主化进程中,具体的、历史的普适价值只能是一种相对性的普适价值。其内涵主要应包括“良宪”和“宪法至上”精神的贯彻;权利与权力关系的处理,尤其是超越公民权与政府权的二元对立思维,寻求二者关系的合理定位;以人文精神为特色的现实性宪政文化。相对性普适价值对不同国家迈向法治化、全球化、现代化提供了可循规律和努力途径。

| Abstract: | In the process of democratization of constitutionalism,specific and historical universal value is relative to some extent.Its connotation shall include the sprit of "healthy constitution" and "constitution supreme".The relationship between entitlement and power shall be properly dealt with to find a rational justification.Relative universality provides a recycling and feasible means for a country's legalization,globalization and modernization. |
