| 摘 要： | 习惯法在一个国家的法律体系中扮演着不可或缺的角色,我国现行立法确立了习惯法的法源地位。由于习惯法具有行业性、地域性、非明示性的特点,司法实践中易造成适用习惯法的混乱状况,因此,必须确立习惯法适用的规则。

| Abstract: | Customary law plays an indispensable role in a nation's law system.The existing Chinese law system grants the source-of-law status of customary law.However,due to the diversity of professions and geographic locations and its implications,customary law practice can easily result in confusion in judicial practice.Therefore,it is necessary to establish rules and regulations for the application of customary law. |
