| 摘 要： | 间接正犯的性质指间接正犯的实行性,是间接正犯理论中的核心问题。由于间接正犯理论本身所具有的复杂性,导致其错误问题带有极大的特殊性。间接正犯错误,主要是事实错误问题。事实错误的解决标准应采用法定符合说,它既适用于同一构成要件内的错误,又适用于不同构成要件间的错误。对于利用者对利用工具性质认识错误与不知情的被利用者中途成为知情者的两种特殊的间接正犯错误,应按教唆犯定罪处罚。
