| 摘 要： | 行政指导代表着现代政府的主要功能和运作方向,必将成为现代中国政府施政的中心手段。如何有效合理地将听证制度适用于行政指导,是一个重要的问题。解决这一问题应从三个方面着手听证范围的确定;在听证程序中引入咨询制度;在听证中禁止单方面接触,适用案卷排他性原则。

| Abstract: | Administration guide represents the main function of modern government, and it is sure to be the central means of governing modern Chinese government. How to effectively apply hearing system to administration guide is an important problem. Three aspects to solve the problem should be taken care of: fixing the range of hearing, introducing consulting system ; prohibiting keeping in touch unilaterally and adhering the principle of isolating files. |
