| 摘 要： | 期待权作为与既得权相对应的一项民事权利在理论上已取得共识,但因立法缺欠而失去了真正的法律保护。事实上期待权是一项具有权利价值、经济价值和诚信价值的独立民事权利,也应通过民事立法加以规范的权利。

| Abstract: | As a corresponding civil right of vested rights,expectancy right has been made consensus in theory.But the real legal protection is lost because of the lack of legislation.In fact,expectancy right is an independent civil right with right value,economical value and honesty value and it should also be regulated by civil legislation. |
