| 摘 要： | 海峡两岸刑法在价值追求、法律渊源等方面的差异,决定了两岸刑法中的遗弃罪在立法规定及司法适用上各具特色,特别是在立法方式、构成特征、适用范围等方面各有优劣得失。将这些方面进行比较,有利于海峡两岸遗弃罪之立法完善。

| Abstract: | The crime of desertion of the two sides has characteristics in the legislative and judicial application because of the cross-strait criminal law in pursuit of values such as the difference between legal sources.From the perspective of comparative criminal law,the article makes a systematic comparative study on penal abandoned on both sides of crime legislation,which constitute the characteristics of the perpetrators and crime established,point out its gains and losses to improve cross-strait crime legislation. |
