| 摘 要： | 在当前职务犯罪侦查中,我国刑事诉讼法规定的五种强制措施法律功能实现的状况和程度令人堪忧,而且与相关制度和措施的关系相当紧张。在立法上完善我国职务犯罪侦查中的强制措施,应寻求惩罚犯罪和保障人权之间的平衡,建构科学、实用的强制措施体系,并改革完善相关制度和措施。

| Abstract: | The five kinds of compulsory measures of the Criminal Procedure Law in the investigation of corruption crimes can not fulfill its legal functions as supposed to be,and has certain tense with the related regulations and other legal measures.To improve the compulsory measures in the corruption crime investigation,crime punishment and human rights protection aims should be balanced,a scientific and feasible system of compulsory measures should be set up and related regulations and measures should also be amended accordingly. |
