我国法治实现的传统法文化阻力

文章认为，中国传统法文化的阻力主要表现在三个方面：儒家学说的内核与法治的精神相冲突，中国传统法文化体系中没有严格意义上的限权思想，中困传统法文化中法律与政治在理论和实践上的混同，如何解决这三个问题是建设有中国特色的社会主义法治中的关键。

The resistant force of China's traditional legal culture chiefly turns out to be the following three aspects: The con-tradiction between the steinkern of the doctrine of the Confucian school and the ideological essence of governing by law. The traditional system of the legal system handly conceives the sense of power; the concept between the law of science and politics from the viewpoint of the traditional law are equivocal both in theory and practice. What matters most in China today is how to solve the Above- mentioned three problems in the process of building socialism with Chinese characteristics in the light of theory- running the state according to law.
