公众视角下我国警察执法合法性来源研究

合法性是指实定法规范的符合性以及社会公众理性判断的统一,涵盖了合法律性和合理性的内涵。基于对权力的合法性来源探究,明晰我国警察执法合法性来源于基本法律层面的权力授予和公众基于事实层面对执法活动作出的价值判断。公众的理性价值判断标准具体包括警察执法过程中的程序规范和警察执法活动的功能属性两方面。公安机关应通过对警察执法的程序和功能属性进行合法性建构,从而获得公众的价值认同。

Study on the Sources of Legitimacy of Law Enforcement from the Perspective of Public

Based on the study of the legitimacy of the power sources, clarify the legitimacy of law enforcement comes from the law and the public value judgments based on the fact of law enforcement activities.To the public, the criteria of value judgments includes the procedure in the course of law enforcement and the functional properties of police law enforcement activities. Public security organs should be focused on the legitimacy of the procedure and functional properties of law enforcement activities, thus obtain the public value judgments.
