涉检信访案件多元化矛盾纠纷解决机制研究

涉检信访制度作为重要的民主监督渠道和重要的权利救济手段,为维护社会稳定、保障群众合法权益发挥了重要作用。现阶段,检察机关着力推进规范司法,深入贯彻群众路线教育实践活动,努力以群众看得见的方式树立司法的公正与权威,但不服检察机关决定、不服法院生效裁判以及不服检察机关查办的职务犯罪结果等群众信访日益多元化和复杂化,涉检信访形势日趋严峻,处置难度进一步加大。因此,必须客观面对当前涉检信访工作面临的突出问题和发展趋势,釆取多元化的工作措施,逐步完善涉检信访的法律保障和工作机制,提高涉检信访案件处置成效,进一步发挥好其积极作用。

Research on the Dispute Resolution Mechanism of the Diversified Dispute Cases Involving the Prosecution

Procuratorial complaint letters and visits system, as an important democratic supervision channel and an important right relief means, has played an important role in maintaining social stability and safeguarding the legitimate rights and interests of the masses. At present, the procuratorial organs are trying to promote judicial norms, carry out the mass line of educational practice, and strive to establish judicial justice and authority by obvious means. However, complaint letters and visits cases such as refusing to accept the decision made by the procuratorial organ and the court, denying the appeal of the prosecutors investigating duty crimes, present an increasingly diversified and complicated situation where the disposal difficulty is extremely huge. Therefore, in order to bring its positive role into full play, we are supposed to face the problems and development trend of the current situation in an objective way, to take diversified measures, and gradually to improve the legal protection, working mechanism and the disposal effect involving procuratorial complaint letters and visits cases.
