关于建立大一统的地上权概念和体系的设想

在目前正在起草的《物权法草案》中,在多处规定了同一性质的土地权利,这些土地权利都是地上权的性质。为此,民法应当建立一个大一统的地上权概念,使之能够涵盖所有性质上属于地上权的土地权利,并在地上权的概念之下进行类型化,这样就会使我国的土地权利制度变得更为系统,便于掌握和适用,同时也便于在国际上进行交流。

On Setting up General Concept conoepe and Sesterm

In the present property law draft which is being made,it stipulated one type in many items.These right all can be fallen in one right,that is easement right.So we should set up a general concept of easement right in which itcan include all these right to which naturally belong easement right.At the same time,categorize the right under the concept of easement right,so it can lead to typically to our real regim,and convenient to grasp and useing,convenient to the conmmunication internationally.
