| 摘 要： | 作为一种人文制度,立宪主义背后蕴涵着深厚的人文精神。对立宪主义语境下的人性,可以沿着三方面的理路进行。其一,就人性的本质而言,立宪主义更倾向于持悲观的态度,即“人性本恶”;其二,就人性的特性而言,立宪主义更倾向于认为人只具有有限理性;其三就人性分析的方法论而言,立宪主义更倾向于采信个体主义。

| Abstract: | Being a humanistic system, constitutionalism contains a high humanistic spirit. Three lines can be taken while we are analyzing humanism in the context of constitutionalism. Firstly, toward the essence of humanism, constitutionalism tends to adopt a pessimistic attitude, namely, it is ready to assume that humanism is inherently evil. Secondly, as for characteristics of humanism, constitutionalism tends to think that human beings only have limited senses. Thirdly, In terms of methodology, constitutionalism tends to analyze humanism from the angle of individualism. |
