浅析公安行政指导理论

传统的行政管理模式强调的是行政机关单方意志和行政权力的单向行使,只注重运用强制性、命令性手段,但这已经无法确保所有领域行政目的的实现,所以出现了这种带有协商、自愿、非强制性的管理手段即行政指导,并将在我国公安管理领域发挥越来越重要的作用。但公安行政指导绝不是离开法治的任意指导。现阶段特别需要加强公安行政指导的基础理论研究,从而促进公安行政指导走上法治化的发展轨道。

The traditional mode of the public security managing emphasizes the unilateralist purpose and officiating singly of the public security organs which only pays attention to the compelling and commanding means.But,that hasn't insured to achieve the administrative aim about the public security field.So, there appears the negotiatory and freewill administrant means without compulsion which is administrative guidance.Therefore,it will play a more and more important role in the field of the public security administration.The public security administrative guidance doesn't mean any random one without law system.A basic theoretical research on the public security administrative guidance must be strengthened at present,and only in this way it can go along the developing path of law system.
