在白银东坪灌区调研的过程中发现了一个“先外后里”的习惯规则,本文阐述其形成过程、合理性以及对当地农业发展的积极作用,同时提出如何解决由于该规则导致的“早收”现象的问题。以此为视角来理解通行权的形成过程以及《物权法》对相邻关系的规定。

Tentative Exploration of the Right to Pass the Adjacent Land:Take the Road of Director Xu''s Family as the Breakthrough Point

In the process of research in Dong Ping town of Baiyin city,the author found a from-utside-to-inside customary rule.This paper presents the process of formation,the rationality,as well as the positive role to local agricultural development;t the same time,discusses how to solve the resulting early revenue phenomenon from the rule,which is taken as a perspective to understand the processes of the right to pass the adjacent land,and property law provisions of the neighboring relations.
