| 摘 要： | 以劳动教养制度为基础的教养处遇制度,是国家为了预防和减少违法犯罪,维护社会治安,对具有特殊危险的人进行矫治、教育、改造,以防卫社会的处分制度。教养处遇的宣告权,根据正当程序原则和经济原则,应属于法院或裁判所。对教养处遇的期限和处遇问题,可以采用“相对不定期”制度,但在处遇内容上应遵守分类处遇原则和递进处遇制度,并加强教养处遇的工资制度的建设。

| Abstract: | Education-labor system, is a penalty system which one country rectifies, educates and reforms the special group with danger to secure the society, preventing them against the law and decreasing the rates of breaking the law. According to the due procedure in principle and the economical principle, the right of declaring education-labor is to belong to the court or judgment office. As far as its time and treatment is concerned, "the relative irregular system" is to adopted, while it should conform to the principle of classified treatment and the development treatment system, meanwhile strengthening the construction of the salary system related to the treatment of the cultivation. |
