论第三人侵害婚姻关系行为之私法控制——建立以“请求权”为核心的二元保护机制

随着社会的发展，我国侵权案件呈逐年增多的趋势，要求加快制定侵权责任法的呼声日益强烈。2008年12月22目，十一届全国人大常委会第六次会议在北京人民大会堂审议《侵权责任法草案》，对现实生活中迫切需要规范的侵权责任以及一些共性问题作出规定。婚姻关系也具有利益性，应当受到尊重和保护，但现行立法因缺乏对第三人侵害婚姻关系行为的有效制约机制，因此导致对第三人破坏性介入行为的放纵。只有确认婚姻关系具有对世性，明确第三人侵害行为的范围和类型，建立以配偶权请求权和侵权请求权为核心的二元保护机制，婚姻关系才能得到切实的维护。

Research on Controls of the Private Law on the Third Party＇s Infringement in a Marriage Relationship

On December 22nd 2008, the draft on tort liability law, taken into deliberation by the 6th session of 11th committee of the National People＇s Congress in the Great Hall of the People, made provisions on tort liabilities and some common problems urgently to be regulated in life. Marriage, a relationship with interests, shall be respected and protected. In the actual law, however, lack of an effective restriction mechanism on the infringements leads to the indulgence of this destructive intervening act. The marriage relationship can be practically safeguarded only by means of gearing the confirmation of marriage relationship to everyone, making clear the scope and types of the third party＇s tort acts and establishing a dualistic protective mechanism based on claim of spouse and torts.
