| 摘 要： | 药品的发展风险是指将产品投入流通时的科学技术水平尚未能发现之危险.药品发展风险的认定要考虑到时间、科学技术水平因素。生产厂家对药品发展风险有观察、警示、召回的义务。在药品发展风险的损害赔偿责任这一问题上,各国普遍是越来越趋向适用无过失责任。

| Abstract: | The development risk of medicines refers to the danger that scientific and technological level still can't be found at that time.Consider time,scientific and technological level factor in asserting in development risk of medicines.The manufacturer has obligation to observe,warn,recall to the development risk of medicines.The compensation for damage responsibility of the development risk of medicines,various countries generally tend to the applicable liability without fault more and more. |
