鉴定结论质证问题研究

鉴定结论必须经过审查判断、查证属实以后，才能在侦查、审判中加以运用。我国鉴定结论的质证程序由于立法的误导和司法实践的误解，存在着严重的形式主义，还远未达到规范化、法制化的要求，因此，建立一套统一的、科学合理的鉴定结论质证程序规则势在必行。完善鉴定结论的质证机制需要配套的程序保障措施，其主要方面为建立庭前对话机制、鉴定人出庭制度的完善和专家顾问制度或专家陪审团制度的建立等。
