人文主义法学视野下的解决权利冲突的原则

人文主义法学在解决权利冲突上的作用主要体现在如下方面:人的需要和利益的多元性决定了解决权利冲突的原则的多元性;人的需要的层次性决定了权利位阶在一定范围内存在;为抑制权利的消极作用,应当克制权利的过度膨胀;解决权利冲突的原则与自由裁量权之间存在约束与反约束的关系.可以尝试提出解决权利冲突的五个原则:权利位阶原则、权利平衡原则、最大利益原则、保护弱者原则、权利克制原则.每一个原则各有其适用范围.应考虑权利冲突的不同情况选择适用不同的原则.

The Rights Conflicts Principle from the Humanist Legal Science Perspective

The effects of humanist legal science on solving rights conflicts mainly manifest in the following aspects:The human needs and the diversity of interests decide the different principles of rights conflicts solution;The human needs hierarchy decides the existence of rights hierarchy within a certain scope;In order to suppress the negative effect of rights,the rights must be restrained not to be excessively expanded;There exists a restrant and counter-restraint relationship between the rights conflict solution principle and the rights of discretion.This paper attempts to propose five principles to solve rights conflicts:The right hierarchy principle,the right balance principle,the biggest benefit principle,protecting the weak one principle and the right restraint principle.Each principle has its applicable scope respectively.It is suggested to select different principle according to the actual situation of rights conflicts.
