| 摘 要： | 秦汉社会是将"孝"法律化的社会,这一时期亲子法强调的是"父母的权利".从简牍材料来看,秦汉子女法律上的孝亲责任主要表现在供养其亲、奔丧居丧、追孝父祖.为亲复仇尽管为社会风尚,但法律却未予肯定;为尊亲相隐汉初为法律禁止,宣帝以后子女获得了隐匿之权,但有汉一代终未发展为法定孝亲责任.

| Abstract: | Filial piety had been put in law in Qin and Han Dynasty. What the laws emphasized in that parenthood was the right of parents.The duty of filial piety was providing for his parents,hastening home for the funeral of his elders and sacrificing forefathers from bamboos.The revenge was fashion in society but not in law. Secreting for elder's sin was forbidden in law at first and children gained the right of secreting after XUAN emperor.But secreting for elder's sin was not the children's duty in law. |
