正义视角下的恢复性司法理念之检讨

在刑事司法过程中如何理好地保护被害人,如何更加有效地使犯罪分子改过自新,成为各国司法面临的一个现实问题。英美国家盛行的恢复性司法对解决上述问题进行了创造性的尝试,给我们提供了一个独特的视角。本文拟从人文视角下的正义观、刑罚观,结合国际社会刑事司法制度的现状,提出恢复性司法理念在中国法学语境下的初步界说。

Review the concept of restorative justice under the just perspective

In the criminal justice process, how to protect the victims better and how to make more effective rehabilitation of criminals,has been a judicial problem faced by many countries.The restorative justice of Britain and the United States has made creative attempt to tackle these issues which provided us with a unique perspective.This paper proposed restorative justice concept in the China Law from the humanities perspective to the concept of justice and penalty, combining the status of the criminal justice system in the international community.
