可持续发展时代的法律变革

文章通过对可持续发展时代社会变革的阐述 ,认为要使可持续发展战略得以实现必须借助于强有力的法律予以保障 ,这就涉及到变革与传统“非持续发展模式”相适应的现行法律的问题。这一变革将以可持续发展为出发点 ,以法律生态化的观念重新调整人与自然的关系 ,对传统的以当代人为本位的法律思想、法律观念、法律价值取向、法律重心、法律救济、立法倾向等进行深刻的反思 ,以崭新的符合可持续发展的法律思想、法律观念、法律价值取向、法律重心、法律救济、立法倾向等予以取代 ,并在此基础上构建可持续发展法律制度。

The Legal Revolution of Sustainable Development Times

This paper focus on expressing the opinion that we can not achieve the stratagem of sustainable development without the guarantee of the law. So the existing law which adapt to the traditional mode of “non-sustainable development” should be transfored. This transformation starts from the idea of sustainable development, and readjust the relationship between the human and the nature with the opinion of ecological-law. This paper focus on pondering over the traditional mentality of law, the concept of law, the value tropism of law, the heart of law, the inclination of legislation etc. The author thinks we should substitute them with new contents which are in accordance with the sustainable development. And based on the new contents, we set up the legal system.
